Terms and Conditions for the Provision of Services by Electronic Means

§1 Organizer’s details

The website www.wedrowiec.krakow.pl (hereinafter: the Website) is operated by the Tourist Guiding Services Office “Wędrowiec” Janina Dziadkowiec-Kozłowska, with its registered office in Kraków, ul. Kościuszki 16, NIP (Tax ID): 676-005-06-27 (hereinafter: the Organizer).

§2 Reservation and conclusion of the agreement

By clicking the “Book” button next to the description of the selected tourist event on the Website and completing all subsequent steps required by the Website, including, in particular, providing the necessary data, the person using the Website (the Customer) expresses the intention to conclude an agreement for the provision of tourist services with the Organizer on the terms indicated in the description of the tourist event to which the reservation relates, as well as on the terms set out in the Agreement and the General Terms and Conditions of Participation available on the Website.

The Organizer will send to the e-mail address provided by the Customer a confirmation of the reservation of tourist services, together with all additional information necessary for the parties to the agreement and required under applicable law.

Acceptance of the Organizer’s offer by the Customer takes place upon payment of 100% of the amount specified in the booking submission. The agreement is concluded on the terms set out in the documents sent in the Reservation confirmation.

After the agreement is concluded, withdrawal from the tourist services is possible in accordance with the Organizer’s Terms and Conditions of Participation in Tourist Events.

The Organizer informs that the 14-day right to withdraw free of charge from a service purchased online does not apply to agreements for participation in a package tour.

§3 Online payments

Available payment methods include:

The entity providing electronic online payment processing is Przelewy24.

If it becomes necessary to refund funds for a transaction made by the payer using a payment card, the recipient of the payment will refund the funds to the bank account assigned to the payer’s payment card.

 

TERMS AND CONDITIONS OF PARTICIPATION IN EVENTS ORGANIZED BY THE TOURIST GUIDING SERVICES OFFICE “WĘDROWIEC” JANINA DZIADKOWIEC-KOZŁOWSKA

CONCLUSION OF THE AGREEMENT

  1. Before signing an agreement for participation in an event organized by the Tourist Guiding Services Office Wędrowiec Janina Dziadkowiec-Kozłowska (hereinafter: the Organizer), the Customer should familiarize themselves with these terms and conditions of participation, which form an integral part of the agreement.
  2. The Customer signing the agreement does so also on behalf of all participants registered in the booking and thereby assumes responsibility for compliance with the terms of the agreement by those participants.
  3. For a minor, the agreement must be signed by the statutory guardian. A minor may participate in an event only with the written consent of the statutory guardians.
  4. Events are carried out according to the programme containing: price, date, route, number of overnight stays, number and types of meals, and the means of transport. The programme constitutes an integral part of the Agreement.
  5. The Customer should promptly notify the Organizer of any changes to the data provided in the agreement.
  6. All participants of group outbound events are insured with Towarzystwo Ubezpieczeń Europa S.A., registered office at ul. Gwiaździsta 62, Wrocław, covering: medical costs including chronic illnesses up to EUR 30,000, accidental injury up to EUR 3,000, rescue costs up to EUR 5,000, and baggage up to EUR 300. A Customer purchasing an event with own transport is obliged to purchase insurance prior to leaving the country. The insured persons’ data will be made available to the Insurer for the purpose of performing the insurance agreement.   7. The Customer may purchase insurance covering the costs of withdrawal from a package tour in accordance with the general insurance conditions of Towarzystwo Ubezpieczeń Europa S.A. For a tour price up to PLN 45,000, the premium amounts to 2.89–6.5% of the tour price; such insurance must be concluded no later than within 3 days from the date of concluding the participation agreement for the tour.

PRICES AND PAYMENTS

  1. The tour price specified in the agreement includes the services expressly indicated in the offer.
  2. The agreement with the Organizer for participation in a tour is concluded on the day the Customer signs the agreement and pays a deposit of 29% of the price. The remaining amount must be paid 25 days before the start of the tour. Failure to pay the balance on time is deemed the Customer’s withdrawal for reasons not attributable to the Organizer and entails costs in accordance with the section “WITHDRAWAL FROM PARTICIPATION IN THE TOUR”.
  3. For tourist events purchased online via www.wedrowiec.krakow.pl, the agreement with the Organizer for participation in the event is concluded upon payment of the full event price specified in the booking submission.

CANCELLATION OF THE EVENT, AMENDMENT OF THE AGREEMENT TERMS

  1. The Organizer may terminate the agreement for participation in a package tour and refund in full the payments made in respect of the tour, without additional compensation or damages, if the number of persons registered for the tour is less than 60% of the places provided for in a given tour, and the Organizer notified the Customer of the termination no later than: a) 20 days before the start of a tour lasting more than 6 days, b) 7 days before the start of a tour lasting 2–6 days, c) 48 hours before the start of a tour lasting less than 2 days,
  2. The Organizer may terminate the agreement for participation in a package tour and refund in full the payments made in respect of the tour, without additional compensation or damages, if the Organizer cannot perform the agreement due to unavoidable and extraordinary circumstances and notified the Customer of the termination promptly before the start of the tour.
  3. The Organizer reserves the right to make unilateral minor changes to the agreement terms. The Organizer will promptly notify the Customer of any change to the agreement terms. 4. A change in the tour price may result from:

– changes in the price of passenger transport resulting from changes in fuel costs or other energy sources,

– changes in the amount of taxes or fees on tourist services covered by the agreement for participation in a package tour, imposed by entities that do not directly participate in its performance (including tourist taxes), changes in airport charges or embarkation/disembarkation fees in ports and at airports,

– changes in exchange rates relevant to the given Tour.

A price change may consist of an increase or a decrease. If the price increase exceeds 8% of the total price of the package tour, the Customer is entitled to accept the proposed changes, or to withdraw from the Agreement without paying a withdrawal fee, or to use a substitute tour. Regardless of the above, within 20 days before the departure date the price agreed in the Agreement may not be changed.

WITHDRAWAL FROM PARTICIPATION IN THE TOUR, CHANGE OF PARTICIPANT

  1. The Customer may withdraw from the agreement for participation in a package tour at any time before its commencement. The date of withdrawal is deemed to be: a) the date the relevant statement is received (by e-mail or by traditional mail), b) the start date of the tour if the Customer does not participate, e.g. fails to appear at the meeting point or fails to appear at the place and time of performance of the services indicated in the programme, voucher or referral.
  2. The Customer may be required to pay an appropriate and justified withdrawal fee to the Organizer. The amount of the fee corresponds to the price of the package tour reduced by saved costs or income from alternative use of the relevant tourist services. At the Customer’s request, the Organizer will justify the amount of the withdrawal fees.
  3. The Customer may withdraw from the agreement for participation in a package tour before its commencement without paying a withdrawal fee if unavoidable and extraordinary circumstances occur at the destination or its immediate vicinity and have a significant impact on the performance of the package tour or the transport to the destination. In such case, the Customer may demand only a refund of payments made in respect of the package tour, without compensation or damages.
  4. The Customer may, without the Organizer’s consent, transfer all rights arising from the agreement to a person meeting the conditions for participation in the package tour, provided that such person assumes all obligations arising from the agreement.
  5. The transfer of rights and assumption of obligations referred to in point 4 is effective towards the Organizer if the Customer notifies the Organizer within a reasonable time. A notification submitted no later than 7 days before the start of the package tour is in any case deemed submitted within a reasonable time.
  6. If the transfer of rights and assumption of obligations referred to in point 4 entails additional costs for the Organizer, the Organizer may demand their payment, and is obliged to demonstrate such costs to the traveller. These costs must be justified and may not exceed the actual costs incurred by the Organizer as a result of the transfer.
  7. For any unpaid portion of the package tour price and costs incurred by the Organizer as a result of the Customer change, the Customer and the person assuming the Customer’s rights are jointly and severally liable..

LIABILITY OF THE PARTIES

  1. The Organizer is liable for the proper performance of all tourist services covered by the agreement, regardless of whether those services are to be performed by the Organizer or by other suppliers of tourist services.
  2. The Organizer limits its liability for non-performance or improper performance of the agreement to three times the total price of the package tour in relation to each Customer. This limitation does not apply to personal injury.
  3. The Organizer is obliged to provide appropriate assistance to a Customer who finds themselves in a difficult situation. Such assistance consists, in particular, of providing: a) appropriate information on health services, local authorities and consular assistance; b) assistance in using means of distance communication, including electronic communications, and in arranging substitute services if provided.
  4. If it is impossible to ensure the Customer’s return to the country in accordance with the agreement due to unavoidable and extraordinary circumstances, the Organizer bears the costs of the Customer’s necessary accommodation, where possible of a category equivalent to that specified in the agreement, for a period of up to 3 nights. This limitation does not apply to persons with reduced mobility and any persons accompanying them, pregnant women, persons under 18 years of age without care, as well as persons requiring special medical care, provided that the Organizer was notified of the situation of such persons at least 48 hours before the start of the package tour.
  5. The Organizer may charge a fee for providing assistance if the difficult situation arose solely due to the Customer’s intentional fault or as a result of the Customer’s gross negligence. The amount of the fee may not exceed the actual costs incurred by the Organizer.
  6. During the event and for its efficient conduct, the Customer is obliged to follow the Organizer’s instructions, in particular to observe punctuality and meeting times.
  7. The Organizer is not liable for inconveniences occurring during the event that result from causes attributable to the Customer.
  8. Additional provisions and declarations: a) By concluding this agreement, the Customer declares that their state of health, as well as the state of health of all persons (including minors) entered in the booking, fully allows participation in the event. The Customer also declares that they have the required documents, i.e. a passport valid for at least 6 months from the return date or a valid ID card (for foreign trips). b) The Customer bears full financial liability towards the Organizer for damage caused by their fault or by the fault of minors registered by the Customer and participating in the event—undertaking to repair such damage or cover it in full. c) During the event and stay at the facility, the Customer is obliged to comply with applicable regulations and rules as defined by law and the rules of the accommodation facility. If the Customer or a participant hinders the proper conduct of the event or the stay for other participants, or lacks required documents, the Organizer reserves the right to terminate the agreement with immediate effect during its performance.

COMPLAINTS

  1. The Customer is obliged to inform the Organizer promptly, where possible during the course of the package tour, of any situations related to non-performance or improper performance of the tourist services covered by the package tour.
  2. In the case of a complaint submitted in writing, it is recommended to submit it promptly after the end of the package tour, as this enables the Organizer to take immediate and possibly effective legal action against subcontractors who contributed to the non-performance or improper performance of the service indicated in the complaint.
  3. The Organizer informs that if the complaint is rejected, the Customer may lodge an appeal with the Organizer or use out-of-court consumer dispute resolution methods referred to in the Act of 23 September 2016 on out-of-court resolution of consumer disputes (Journal of Laws, item 1823) and the online dispute resolution platform pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/11/EC (Official Journal of the EU L 165 of 18.06.2013).
  4. Any disputes that may arise in connection with the performance of the Agreement shall be settled amicably, and in the absence of an agreement—by a common court.

FINAL PROVISIONS

  1. If the agreement regulates individual issues differently than these terms and conditions of participation, the provisions of the agreement shall prevail.
  2. In matters not regulated by this agreement, generally applicable provisions of law shall apply, in particular the Act of 24 November 2017 on Package Travel and Linked Travel Arrangements and the Act of 23 April 1964 – the Civil Code.

CONFIRMATION OF HAVING A GUARANTEE

The Tourist Guiding Services Office “Wędrowiec” Janina Dziadkowiec-Kozłowska, acting as a tour operator entered in the register No. D/82/99/177/2004 by the Marshal of the Małopolskie Voivodeship, confirms that the following security has been provided:

– payment of the amount necessary to cover the costs of returning customers from the package tour to the place of departure or planned return, where the Organizer fails to ensure such return despite the obligation,

– refund of payments made as consideration for the package tour where, for reasons attributable to the Organizer and persons acting on its behalf, the tour is not carried out,

– refund of part of the payments made as consideration for the package tour, corresponding to the part of the tour that will not be carried out for reasons attributable to the Organizer and persons acting on its behalf

  1. This security has been provided in the form of a tourist insurance guarantee No. GT 722/2025 issued by Towarzystwo Ubezpieczeń Europa S.A. in favour of the Marshal of the Małopolskie Voivodeship.
  2. The guarantee is issued for the amount of PLN 29,867.60.
  3. The guarantee is valid from 04.01.2026 to 03.01.2027 and covers claims securing agreements concluded and performed up to that date.
  4. The original guarantee is held by the Marshal of the Małopolskie Voivodeship with its office in Kraków, ul. Basztowa 22 (correspondence address: ul. Racławicka 56, 30-017 Kraków).
  5. A Customer seeking coverage of the costs of their return to the country in a situation where the tour operator or travel intermediary, despite the obligation and despite being requested, does not ensure such return, should promptly contact the Marshal of the Małopolskie Voivodeship at tel. 12/37-96-029 or 028, e-mail: uslugiturystyczne@malopolska.mw.gov.pl, or the nearest consular post, and present the agreement for the provision of tourist services as well as a statement confirming the tour operator’s or travel intermediary’s failure to perform the obligation to ensure return to the country.
  6. A Customer seeking a refund of payments made or part thereof in the event of non-performance of contractual obligations should contact the Marshal of the Małopolskie Voivodeship or the Guarantor. The following should be attached to the request for payment:

– a copy of the agreement for the provision of tourist services,

– a copy of proof of payment for the package tour,

– a statement confirming non-performance by the tour operator of contractual obligations of a specified value,

– a statement indicating the bank account to which the payment under the guarantee should be made, or indicating another method of payment under the guarantee.

  1. If the insurance guarantee agreement proves insufficient to cover the costs of returning customers to the place of departure or planned return, or to refund payments or part of payments made for the package tour, the voivodeship marshal or a unit designated by the marshal applies to the Insurance Guarantee Fund with its registered office in Warsaw, ul. Płocka 9/11, for the payment of funds from the Tourist Guarantee Fund.
